How is mediation different from going to court?

Mediation is a private, collaborative process that allows you to create your own solutions instead of having a judge make decisions for you. It’s faster, more cost-effective, and encourages longterm cooperation.

Mediation itself is not legally binding, but if the parties reach a written agreement, it becomes binding once signed (as a contract) or filed with a court (as a court order). In other words, the process is voluntary, but the outcome can be enforceable.

If the other party refuses mediation, the process can’t move forward unless it’s court-ordered; in that case, refusal can lead to penalties or unfavorable rulings. Otherwise, you may need to resolve the dispute through negotiation or the courts.
